Copyright, Fair Use, and the Public Domain

What is the Public Domain?

Works that are no longer under copyright protection are in the public domain. Works in the public domain can be freely used without permission. There are four common ways that a work enters the public domain:

  • the copyright has expired
  • the owner of the copyright failed to follow copyright renewal rules
  • the owner of the copyright forfeited copyright or deliberately placed their work in the public domain
  • copyright law does not apply to the type of work
